Chandigarh, the city beautiful seems to have lost the beauty and is stepping into a world of crime. Every day we hear one or two incidents of crime happening in Chandigarh and it is an alarm to the Chandigarh administration.
A 17-year-old ManiMajra boy was sentenced to a prison of 20 years by a local court for raping his 16 years old cousin. The court has also directed the convicted boy to pay a fine of Rs. 1.05 lakhs, out of which Rs. 1 lakh would be sent to the victim. He with his co-conspirator Hari Prasad (21), was accused in the case. Both of them were being tried separately.
As of now, the 17-year-old is sent to the Juvenile home until he becomes an adult. As per court orders, he would be transferred to the Burail Jail as soon as he reaches 18. Earlier the juveniles were tried in the special juveniles court only but as per the revised guidelines, in case of a heinous crime, the juveniles are to be tried in the normal courts only.
Details of the Case
On August 20, 2016, it so happened that the victim after having an argument with her mother went to his brother’s house in Manimajra. According to her, she was sitting there on the staircase waiting for her brother as he was not there. At around 11 pm her cousin who is living on the ground floor of the same house took her to a to a secluded room forcibly. As per the victim, her cousin and the other convicted person raped her and then fled away from there. She informed this incident to her mother who later took her to the police station to register a complaint against the culprit.
A case of rape under section 376 of Indian Penal Code and under section 8 of POSCO was registered on her complaint. The other accused, Hari Prasad is also under police custody and facing the trial separately.
The defense claimed the point that the victim has put a false allegation on the convicted due to a dispute which was going on in the family. However, they were found guilty by the court.
